By accessing or using any pehtwand platform, API, or service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
pehtwand provides banking-as-a-service infrastructure, including payment processing, ledger management, account issuance, and related APIs to licensed financial institutions and technology companies. Services are provided subject to applicable regulatory requirements and may vary by jurisdiction.
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] of any unauthorized use.
All fees are quoted in USD unless otherwise stated and are due in accordance with your agreed billing schedule. pehtwand reserves the right to suspend access for overdue invoices after a 10-day grace period. All fees are non-refundable except as expressly stated in your service agreement.
All platform software, documentation, trademarks, and content are the exclusive property of pehtwand or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the services solely for your internal business purposes.
You may not use pehtwand services for unlawful purposes, money laundering, fraud, financing of terrorism, or any activity that violates applicable laws or regulations. You may not reverse-engineer, decompile, or attempt to extract the source code of any pehtwand software. Violation may result in immediate termination and legal action.
pehtwand processes personal and financial data in accordance with our Privacy Policy and applicable data protection laws, including GDPR where applicable. By using our services, you consent to such processing. You retain ownership of your customer data and grant pehtwand a limited license to process it solely to deliver the services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. pehtwand does not warrant that the services will be uninterrupted, error-free, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, pehtwand'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL pehtwand BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Either party may terminate these Terms upon 30 days' written notice. pehtwand may suspend or terminate your access immediately for cause, including material breach of these Terms, failure to pay, or regulatory requirements. Upon termination, your right to access the services ceases immediately.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved by binding arbitration in Wilmington, Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.
pehtwand reserves the right to update these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-platform notification. Continued use of the services after the effective date constitutes acceptance of the revised Terms.
